FIELD MANAGER (hereinafter referred to as the “Service”) is provided by BASF Digital Farming GmbH (hereinafter referred to as “us” or “we”). You can find more information on the provider of this website in our legal notice.
A. Handling of personal data
In the following, we would like to inform you about how we handle personal data when you use this Service. Unless otherwise stated in the following sections, the legal basis for handling your personal data results from the necessity of data handling in order to provide the Service and the functionalities requested by you and for invoicing purposes. We also process data from the Service for other business purposes of the BASF Group, such as for the further development, production, and/or marketing of our products and services (including statistical purposes and for the continual improvement of our offers; in these cases, processing is carried out exclusively on an anonymous basis so that personal data cannot be traced back to you).
I. Use of the Service
If you use our Service, your browser transfers certain data to our webserver for technical purposes in order to provide you with the information you have called up. In order to enable the use of the Service, the following data are collected, stored in the short-term, and used: In order to safeguard our legitimate interests, we also store these data for a limited time so that we may derive personal data in the event of unauthorised access or attempted access to the local server.
1. Registration and login
In order to use our Service, you must first register with a user account. You can set your personal login details at a later login. When you register and login later, we process the following information about you:
- First name and surname
- Contact details (including email address and telephone number for queries)
- Username and password
- Log data about your logins, including time stamp
We process these data in order to enable access to our Service. The data are automatically deleted upon deactivation of your user account.
2. Use of cookies
a) What are cookies?
We use so-called “cookies” on the Service’s website. Cookies are small text data files that are stored in the memory of your terminal device via your browser. Cookies save certain information (e.g. your preferred language or page settings) that can be sent back to us by your browser when you revisit the website (independent of the lifetime of the cookie).
b) Which cookies do we use?
We differentiate between two types of cookies: (1) function-related cookies, without which the functionality of our website would be limited, and (2) optional cookies, which are used for website analysis and marketing purposes. c) How you can prevent the use of cookies
You can, of course, use our website without any cookies. You can configure or completely deactivate the use of cookies in your browser’s settings at any time. However, this can result in limitations in the functions or the user friendliness of our offer. You can refuse the use of optional cookies at any time by using the corresponding opt-out option in the table above.
3. Website analysis
We use Google Analytics on the website of our Service. This is a web analysis service of Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, United States (hereinafter referred to as “Google”).
Google analyses your use of this website on our behalf. In this regard, we use cookies, among others, that are described in detail in the cookie table above. The information about your use of this website collected by Google (e.g. referring URL, pages you visit on our website, the web browser you used, your language setting, the operating system you used or your screen resolution) is transferred to a Google server in the US, saved there, analysed and we are provided with the result in anonymous form. Your user data are not connected to your full IP address. We have activated the IP anonymisation function offered by Google on this website so that the last octet (type Ipv4) or the last 80 bits (type Ipv6) of your IP address are deleted. Google is also certified in the EU-US Privacy Shield, meaning that an adequate level of data protection is established for data at Google in the US.

We shall only analyse your use of our Service if you provide your consent when you first access the Service or if you activate the above button for turning App Analytics on/off. You can revoke your consent at any time via this button.
4. Online behavioural advertising
Our Service’s mobile app uses “Adjust”, a so-called targeted advertising service from adjust GmbH, Saarbrücker Straße 36, 10405 Berlin, Germany (hereinafter referred to as “Adjust”).
If you download our mobile app through certain marketing campaigns (e.g. you download the app after having entered the app store by clicking on a certain advertising banner), Adjust analyses your use of the app (e.g. which parts of the Service you have used the most). For this purpose, in addition to usage data, the following data may be processed: IP address, MAC address, mobile identifiers depending on your mobile device such as iOS IDFA and IDFV, Android ID or Google Advertising ID (as long as Google Play services was activated on your mobile device), Windows IDS. The data are transferred to an Adjust server, on which they are stored and analysed. The corresponding results are sent back to us in anonymous form. Our partner Adjust and we use the information to adjust our advertising campaigns to you and your interests, to assess the effectiveness of our promotional campaigns and to better understand usage behaviour of users after you have viewed a certain advertisement and subsequently downloaded our mobile app.

By accepting our Data Privacy Policy Terms and Conditions, you hereby agree to data processing as described above as part of online behavioural advertising.
You have the option to revoke your consent to such an analysis of your usage behaviour at any time by either uninstalling the mobile app from your mobile device or visiting the website https://www.adjust.com/opt-out/, selecting the device to which the revocation shall apply and specifying the identifier of your mobile device (opt-out). 5. E-mail marketing
If you have given us your consent to do so, we will share your personal data as listed below with the BASF company which is locally responsible for you based on the location of your business as specified in your consent (together "We"). You can find an overview of the respective BASF Agricultural companies here. For the purpose of providing you with personalized agricultural relevant information and advice, we will process the following of your personal data in order to send marketing e-mails to you:
- Name
- E-mail-address
- Mobile phone number
- Field-, field-zone and time-specific information:
- Primarily generated data through your usage of xarvio products, such as:
- Soil e.g. tillage, soil type
- Seeding e.g. seed variety, density, seeding date
- Field observations e.g. disease/weeds observations
- Irrigation e.g. amount of water
- Fertilization e.g. timing, N, P, K amount used
- Crop protection e.g. products and dose rate used
- Harvest e.g. yield
- Machine data e.g. as applied maps
- Remote data and model-based data e.g. (model data is based on farmer generated, remote and BASF data)
- Satellite data e.g. visible spectrum, infrared spectrum, elevation levels
- Climatic data e.g. rain fall, air temperature, humidity
- Data from field-, machinery- or other sensors e.g. Insects, Weeds, Diseases, Crop Emergence, Crop Growth Stage, Nutrition or Water availability
- Primarily generated data through your usage of xarvio products, such as:
The Field-, field-zone and time-specific information are necessary for personalizing the agricultural relevant information which we provide you with.
We will share your personal data with other affiliated companies of the BASF Group if they provide IT services for us or if this is necessary for operational reasons. Furthermore, we will pass on your personal data to the technical IT service providers we use from whom we obtain services. Our IT service providers are carefully selected and regularly checked by us. They process personal data only on our behalf and strictly in accordance with our instructions on the basis of corresponding contracts for order processing. In some cases, e.g. in the case of WhatsApp, the service provider might be located in a country outside of the EU which might not have a level of data protection comparable to the GDPR. By applying to our marketing services, you explicitly consent to the transfer of your personal data into such third countries.
We store your personal data collected within the scope of your consent for the above-mentioned purposes until your consent is revoked.
The legal basis for the processing of your personal data for the above-mentioned purposes is your consent, Art 6, paragraph 1, lit. a) GDPR.
You can revoke your consent at any time with effect for the future by clicking the unsubscribe link in the marketing e-mails.
You are at liberty to grant or withhold consent. This has no effect on the use of this Application.
If you revoke your consent, we will delete your personal data immediately, provided that we process them for marketing purposes on the basis of your consent. Please note that the revocation does not result in the deletion of all your personal data which we process in the course of the business relationship with you, if there is another legal basis for this. The revocation of your consent does not affect the legality of the data processing that has taken place up to that point.
II. Transferring data for processing on our behalf
In order to process your data, we partly use specialised service providers. Our service providers are carefully selected by us and regularly controlled. They process personal data only on our behalf and strictly in accordance with our instructions that are based on corresponding agreements on job processing.
III. Processing data outside the EU/EEA
Your data are also partly processed in countries outside the European Union (EU) or the European Economic Area (EEA), where, in general, a lower level of data protection than in Europe may prevail. In these cases, we ensure (e.g. through contractual agreements with our contracting parties) that an adequate level of data protection is guaranteed for your data, or we shall ask for your express consent.

You may exercise the following rights based on the applicable data protection laws:
- The right of access to personal data about you that have been saved;
- The right to rectification, to erasure or to restriction of processing your personal data;
- The right to object to processing that does not serve our legitimate interests, public interest or profiling, unless we can demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms or for the establishment, exercise or defence of legal claims;
- The right to data portability;
- The right to lodge a complaint to a supervisory authority;
