1. Accessing the website / app

When you access our service, your browser / terminal device transmits certain data to our web server for technical reasons in order to provide you with the information you have accessed. In order to enable you to use the service, the following data is processed:

In addition, personal data, such as the GPS location of your agricultural land, can be shared with other users of the app, provided that you share your farm information with them in the app.

In addition, you can contact us by phone or email if you have any questions about the service and its features or a technical problem. In this case, we process your information to process your request.

4. Use of the "Healthy Fields" function

(a) Use of "Healthy Fields" as contractors

For the purpose of registration as a contractor within the framework of "Healthy Fields" and for the actual awarding of orders and their execution, we process your contact data and your business contact data (company, address).

The legal basis for the processing of this data is the performance of the contract we have concluded with you and our legitimate interest in offering our customers a full service.

(b) Use of "Healthy Fields" as a customer

For the registration of fields within the framework of "Healthy Fields", we process the GPS data on the position of your agricultural land, data on the individual planting (crops) of your agricultural land, as well as your contact details provided in the order form. You can select the fields that you have created as part of your use of our functions. The processing of the data is first necessary to verify your order. The legal basis for this is the implementation of necessary pre-contractual measures, which are carried out at your request.

If we confirm your order, the processing of this data is necessary to fulfil our contractual obligations to you. The legal basis for this subsequent processing is then the performance of the contract we have concluded with you.

(c) Use of "Healthy Fields" as a trading partner and bonus entrepreneur

For the purpose of registering trading partners (e.g. suppliers, cooperatives) and bonus companies within the framework of "Healthy Fields" and for the actual awarding of orders and their implementation,we process your contact data and your business contact details (company, address).

The legal basis for the processing of this data is the performance of the contract we have concluded with you and our legitimate interest in offering our customers a full service.

(d) Disclosure of personal data within the framework of "Healthy Fields"

If and to the extent necessary for the performance of the contract, we pass on personal data to certain recipients.

In particular, as part of the fulfilment of the contract, we pass on customer data (contact data, information on registered fields and ordered tasks) to contractors, trading partners and bonus companies so that they can fulfil the contractually agreed service to the customer on our behalf.

Furthermore, as part of the fulfilment of the customer contract, we provide contact data, which may also be personal data, from contractors, trading partners and bonus companies to our customers in order to enable appointments and other coordination between the parties involved in the performance of the contract.

If and to the extent necessary, we also provide contact data of contractors to trading partners and bonus contractors, if and to the extent that this becomes necessary in the context of the fulfilment of the customer contract.

5. Further development of the Services

We process the GPS data on the location of your agricultural land for the further development and improvement of our service. We use a scale of 10km x 10km to exclude the reference to a specific field as far as possible. The processing is necessary in order to be able to take into account the geographical location of your agricultural land and the associated peculiarities in the further development. The legal basis is our legitimate interest in the continuous optimization of our services.

6. Newsletter

We process your e-mail address in order to send you our newsletter with information about our services and products. The legal basis for this processing is our legitimate interest in advertising our own similar goods or services in connection with § 7 (3) of the Act against Unfair Competition (UWG). 7.Marketing Email

If you have given us your consent to do so, we will share your personal data listed below with basf's subsidiary, which is responsible for you locally based on your local business location specified in your consent (collectively, "we"). In order to provide you with personalized, agriculturally relevant information and advice, we process the following personal data to send you marketing emails:

The field, field area and time specific information is necessary to personalize the agriculturally relevant information we provide to you.

We pass on your personal data to other affiliated companies of the BASF Group if they provide IT services for us or if the disclosure is necessary for operational reasons. In addition, we pass on your personal data to the technical IT service providers we use and from whom we obtain services. Our IT service providers are carefully selected and regularly checked by us. They process personal data only on our behalf and in accordance with our instructions, based on the relevant contracts for order processing. In some cases, such as WhatsApp, the service provider may be located in a country outside the EU that may not have a level of data protection comparable to the GDPR. By registering with our marketing services, you expressly consent to the transfer of your personal data to these third countries.

We store your personal data collected as part of your consent for the above-mentioned purposes until you withdraw your consent.

The legal basis for the processing of your personal data for the above-mentioned purposes is your consent, Art. 6, para. 1, lit. a) GDPR.

You can withdraw your consent at any time with effect for the future by clicking on the unsubscribe link in the marketing emails.

You are free to give or refuse your consent. This does not affect the use of this application.

If you withdraw your consent, we will delete your personal data immediately. The prerequisite for this is that we process them for marketing purposes on the basis of your consent. Please note that the revocation does not lead to the deletion of all your personal data that we process in the context of the business relationship with you, if there is another legal basis for them. The revocation of your consent does not affect the legality of the data processing carried out up to this point in time.

8. Transfer to BASF Group companies

In certain cases, we transmit your name and contact details to BASF Group companies. On the one hand, this can be done for marketing purposes on the basis of your consent. In addition, we transmit this data as far as this is necessary for the provision of our services. The legal basis for this processing is the necessity of the processing for the performance of the contract we have concluded with you. A list of these Group companies can be found under II. We also process your personal data in our Group-wide customer data management system. 9. Data exchange with other providers of digital agronomic services

You have the option of importing information from providers of other agronomic services you use into the Fieldmanager. To do this, you must release the corresponding information in the respective other service using your user ID and password. We only receive a personalized token for the purpose of importing the data and do not have access to your user ID and password for the other service.

10. Transfer to other external service providers

In order to provide you with information about the soil, weather and climate conditions for your respective farm, we need to request this data from external service providers using gps data on the location of your agricultural land. For this purpose, this GPS data is transmitted to the respective service provider.

Furthermore, we pass on your personal data to the service providers we use, such as banks, credit institutions and technical IT service providers. Our service providers are carefully selected by us and regularly checked. In particular, our technical IT service providers process personal data mainly on our behalf and then strictly in accordance with our instructions on the basis of corresponding contracts for order processing. In addition, we also transfer your data to third parties (e.g. banks and credit institutions), insofar as this is necessary for the execution of the contract with you. in some cases, however, they may also act independently with your data. In the latter case, the responsibility under data protection law lies with the respective service provider; further information on data processing can be obtained from them.

11. Joint responsibility with KWS SAAT SE & Co. KGaA

We are jointly responsible for data processing within the framework of the Field Manager function KWS Corn harvest timer with KWS SAAT SE & Co. KGaA, Grimsehlstraße 31, 37574 Einbeck within the meaning of Art. 26 para. 1 GDPR. We transmit data to KWS SAAT SE & Co. KGaA, which are analyzed there and, with the help of the KWS Corn harvest timer field manager function, offer the opportunity to determine the right time for the corn harvest on the basis of field analyses. The processing of this data takes place on the basis of your consent.

We have concluded an agreement on joint responsibility with KWS SAAT SE & Co. KGaA, which regulates responsibilities and responsibilities within the framework of joint responsibility.

Within the joint responsibility, we are responsible for the collection of the data, for the forwarding of the data to KWS SAAT SE & Co. KgaA as well as for the data processing in the context of the operation of the Field Manager and KWS Corn harvest timer. In addition, we are responsible for being the contact and contact person for all topics relating to data protection and comply with the information obligations pursuant to Art. 13.14 GDPR with this data protection declaration. KWS SAAT SE & Co. KGaA is responsible for data processing in the context of the field analysis as well as the subsequent recommendation and transmission to us.

Even if we are the point of contact for data protection issues, you can assert your rights, which you are entitled to under Art. 15 -- 22 GDPR, against both parties. We have agreed with KWS SAAT SE & Co. KGaA that we will immediately inform each other of any legal positions asserted by those affected. We provide each other with all information necessary to respond to requests for information and to fulfil other rights of data subjects. We continue to support each other in the investigation and processing of possible personal data breaches as well as in correspondence with a competent data protection supervisory authority.

12. Use of cookies

(a) What cookies are

We use so-called "cookies" on the website of the service. Cookies are small text files that are stored in the memory of your device via your browser. Cookies store certain information (e.g. your preferred language or page settings) that can be sent back to us by your browser when you visit the website again (depending on the lifetime of the cookie).

(c) How to prevent the use of cookies

You can configure or completely deactivate the use of cookies in the settings of your browser at any time. However, in this case, you can no longer use Field Manager.

13. Error analysis and correction

If your use of the Service malfunctions or crashes, an error report will be generated, which we will analyze to identify the source of the error and eliminate the error. This is necessary in order to be able to provide you with our service as error-free as possible and in the quality you expect. If you do not want this function, you can deactivate the error analysis and correction in via the settings. However, this means that we are unable to detect and correct any malfunctions and thus the quality of the service suffers.

14. Field boundary and plant recognition

We process the central GPS position of the agricultural area (field) and the crop grown on it at any given time to further develop and improve our field boundary and crop recognition systems. This anonymized processing is necessary to increase the accuracy of predictions in development. The legal basis for this processing is our legitimate interest, which results from the aforementioned purpose, Art. 6 sec. 1 lit. f) GDPR.

II. Disclosure of data for processing on our behalf

To process your data, we sometimes use specialized service providers. Our service providers are carefully selected by us and regularly checked. They process personal data only on our behalf and strictly in accordance with our instructions on the basis of corresponding contracts for order processing.

We transfer your personal data to our partner companies, who provide us with satellite images and information about the nature of the soil of the corresponding agricultural land.

The authentication process to our Field Manager is carried out by our service provider SAP Deutschland SE & Co. KG, Hasso-Plattner-Ring 7, 69190 Walldorf.

We use the CRM module of the Salesforce.com, represented in Germany by: Salesforce.com Germany GmbH, Erika-Mann-Str. 63, 80636 Munich, Germany, for customer service, to improve the user experience of our services and for advertising purposes. For the hosting of our service we use the cloud services of Amazon Web Services, 410 Terry Ave North, Seattle, WA 98109-5210. Your data is hosted on servers in the European Union.

We pass on your data to the following BASF Group companies for the purposes listed in this privacy policy:

III. Processing of data outside the EU /EEA

Your data will also be processed in countries outside the European Union ("EU") or the European Economic Area ("EEA"). Please note that not all third countries have a level of data protection recognised as adequate by the European Commission. For data transfers to third countries in which there is no adequate level of data protection, we ensure before the transfer that the recipient either has an adequate level of data protection (e.g. through the agreement of so-called EU standard contractual clauses of the European Union with the recipient) or has the express consent of our users.

You can obtain a copy from us of the specifically applicable or agreed regulations to ensure the appropriate level of data protection. Please use the information in Section C for this purpose.

IV. Storage period of your personal data

We store your personal data that you have provided to us for the registration of your user account until you deactivate your user account. After deactivating your user account, your personal data will be deleted.

The processing of your personal data for the dispatch of our newsletters takes place until the time of revocation of your consent.

In all other respects, your Personal Data will be deleted insofar as they are no longer required to fulfil the purpose of storage, unless statutory retention obligations (e.g. retention obligations under commercial and tax law) preclude deletion.

B. Information about your rights

The following rights are available to you under applicable data protection laws:

Right of access: The right to information about your personal data processed by us and about certain other information (such as that given in this Privacy Policy), as well as the right to a copy of this data;

Right to rectification: If your personal data is inaccurate or incomplete, you have a right to rectification;
